Eligibility: Open to legal residents of the State of New York who are 18 years or older, except employees, officers, directors, representatives and agents of ZocDoc, Inc. (“Sponsor”), its affiliated companies, retailers, suppliers, advertising, promotion and administrative agencies and all others associated with the development and execution of this sweepstakes (hereafter, collectively “Released Parties”), and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in their same household, whether or not related. By accepting the prize, each winner understands and assumes the risks of travel to and attendance at the concert.

Void where prohibited, or otherwise restricted by law. This sweepstakes is subject to all applicable federal, state and local laws and regulations.

To enter between 12:00:00 AM Eastern Time (“ET”) on 8/03/08 and 11:59:59PM ET on 10/1/08 (the “Promotion Period”), visit www.ZocDoc.com/ClassOf2012 and sign up for ZocDoc service with confirmed email and phone number. Limit of one entry per person for the duration of the Promotion Period. Multiple entries for any one person/email/phone number will void all but the initial entry. Incomplete, duplicate, mechanically reproduced, automated or photocopied entries are not permitted and will be deemed void. In the event of a dispute as to the identity of an online entrant, entrant will be deemed individual named on the ZocDoc service account regardless of whether that individual is the authorized account holder of the email address at issue. Released Parties are not responsible for lost, late, stolen, incomplete, damaged, garbled, delayed, undelivered, inaccurate, illegible or misdirected entries, text messages or transmissions, interrupted or unavailable network, server or other connections, miscommunications, failed computer hardware or software or telephone transmissions or technical failures, malfunction of phones (including wireless phones/handsets), phone lines or telephone systems or other communication malfunctions, cellular equipment tower, telephone systems, wireless service problems, errors or malfunctions, garbled, misrouted, scrambled transmissions or other errors or problems of any kind whether mechanical, human, network or electronic or otherwise relating to or in connection with the sweepstakes, including, without limitation, errors which may occur in connection with the administration of the sweepstakes or the processing of entries; for inaccurate entry or other sweepstakes related information, printing, typographical or other errors appearing in the rules, or in other sweepstakes related materials. Sponsor is not responsible for injury or damage to any entrant’s or any other computer resulting from downloading any materials in connection with this sweepstakes. By participating, entrants agree to abide by these Official Rules and to the decisions of the Sponsor and judges, which shall be final and binding in all matters relating to this sweepstakes. All entries become the property of Sponsor and will not be acknowledged. Any use of robotic, automatic, programmed or similar entry methods will void all entries submitted by such methods.

Weekly Prize Winner Selection: Prize winners will be selected in four (4) random drawings conducted on or about 9/11/08, 9/18/08, 9/25/08, and 10/02/08 from among all eligible entries received for the entire Promotion Period prior to drawing date by ZocDoc, Inc. (each a “Weekly Prize”). Decisions will be final and binding in all matters relating to this sweepstakes. Odds of winning will depend on the time of entry and the number of eligible entries received for the entire Promotion Period to date. Potential Prize winners will be notified by email or telephone.

Entries received for one (1) Weekly Prize drawing will carry forward to and be included in subsequent Weekly Prize drawings. Odds of winning a Weekly Prize will depend on the time of entry and the total number of eligible entries received for the applicable drawing as outlined above.

Prizes: Four (4) Prizes will be awarded, each consisting of four (4) tickets to a concert venue of winner’s choice, maximum retail value of $100 per ticket. Exact date and location of seats are at the discretion of Sponsor. All prize details are at Sponsor’s sole discretion. Prize details are subject to change at Sponsor’s sole discretion. Certain terms, conditions & restrictions on special events or passes may apply. Prizes are awarded “as is” without warranty or guarantee either express or implied by Sponsor. Any and all warranties and/or guarantees (if any) shall be subject to the dealer’s terms therefore (each winner agrees to look solely to such dealer for any such warranty and/or guarantee, if any). Winners are solely responsible for all federal, state and local taxes and any other costs and expenses associated with the acceptance and use of a prize not specified herein as being awarded, including, but not limited to, transportation, and refreshments and other incidentals while at the event. Total Approximated Retail Value (“ARV”) of all prizes: $1,600. Sponsor will not be responsible or liable in the event any concert for which a prize is awarded is postponed or cancelled for any reason. No additional tickets will be provided or exchanged and no cash or other awards will be substituted for concert tickets should a concert be postponed or cancelled.

Miscellaneous: No transfer, assignment, cash redemption, or substitution of prize (or portion of prize) permitted except by Sponsor who reserves the right to substitute a prize (or applicable portion of prize) of comparable or greater value, at its sole discretion. Potential Grand Prize winners & recipients of prizes valued at $400+ will be required to execute and return an affidavit of eligibility, a liability release, and where permitted by law, a publicity release within ten (10) days of date of issuance of notification. Failure to satisfy the foregoing, comply with these Official Rules or any prize notification or prize being returned as non-deliverable for any reason will result in prize being forfeited and, at Sponsor’s discretion, an alternate winner may be selected from all remaining eligible entries. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes or ZocDoc site; to be acting in violation of these rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. By entering, entrants agree: 1) that Sponsor & its designees shall have the right and permission to use entrant’s name and/or picture and/or likeness or biographical information or voice for trade, advertising, promotional and/or any other purpose in any media now or hereafter known throughout the world in perpetuity without any further compensation, consideration, permission or notification except where prohibited by law; and 2) that the Released Parties shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in this sweepstakes. Only the number of prizes stated herein will be awarded. Sponsor reserves the right, in its sole discretion, to void suspect entries and/or modify, terminate or suspend this sweepstakes (or any portion thereof) should a virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Sponsor corrupt or impair the administration, security, fairness or proper play of the sweepstakes and, in the event of termination or suspension of the sweepstakes, at its discretion select winners for the drawing at issue from all eligible, non-suspect entries received prior to event requiring such termination or suspension.
